1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of DeltaTrace, the web-based Formula 1 data analysis tool available at https://www.delta-trace.com/ ("Service", "DeltaTrace"). By accessing or using DeltaTrace, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not access or use the Service.

3. Use of the Service

You may use DeltaTrace only for lawful purposes and in accordance with these Terms.

In particular, you agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Service, its servers or related systems.
• Interfere with or disrupt the operation of the Service (for example, by overloading it with automated requests).
• Use DeltaTrace to create, train or improve any competing product or service without prior written permission.

We reserve the right to suspend or restrict access to the Service if we reasonably believe that you are in breach of these Terms or that your use poses a risk to the Service or other users.

4. Data sources and accuracy

DeltaTrace uses timing and telemetry data from third-party motorsport data providers such as OpenF1 and Jolpica, as well as other sources that may be added over time.

While we aim to provide accurate and useful analysis, we cannot guarantee the completeness, accuracy or timeliness of any data or results displayed in DeltaTrace. The underlying data is provided on an "as is" basis by external providers, and may contain errors, gaps or inconsistencies.

You are responsible for how you use and interpret any data, graphs or outputs from DeltaTrace. The Service is not intended for safety-critical decision-making and should not be relied upon as the sole source of truth for sporting or commercial decisions.

5. Accounts

DeltaTrace may be accessible without an account or may, in future, offer user accounts or additional features that require authentication.

If user accounts are introduced:

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your login details.
• You must notify us promptly if you suspect unauthorised use of your account.

We reserve the right to close or suspend accounts that are inactive for an extended period, or that we reasonably believe are being misused.

6. Telemetry data and user content

The telemetry and timing data displayed in DeltaTrace is provided by external data providers, not by you. You do not acquire ownership of this data by using the Service.

If, in the future, DeltaTrace allows you to upload or submit your own content (for example, custom telemetry files, comments or feedback), you remain responsible for that content and must ensure you have the rights to submit it.

By submitting any content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, display and process that content solely for the purpose of operating and improving DeltaTrace.

You must not upload content that is illegal, infringing, defamatory, or otherwise violates the rights of others.

7. Intellectual property

All rights, title and interest in and to the DeltaTrace Service, including its design, user interface, code, and features, are owned by or licensed to us and are protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your own personal or internal purposes, subject to these Terms.

You may not:

• Copy, modify, distribute, sell or lease any part of the Service.
• Reverse engineer or attempt to extract the source code of the Service, except where permitted by mandatory law.
• Use any trademarks, logos or branding associated with DeltaTrace without our prior written consent.

8. Third-party services and links

DeltaTrace may link to or integrate with third-party sites or tools, such as:

• Motorsport data providers (e.g. OpenF1, Jolpica).
• Hosting and infrastructure services.
• Web analytics services such as Google Analytics 4.
• Error reporting or monitoring tools.

We do not control and are not responsible for the content, policies or practices of any third-party websites or services. Your use of those services is at your own risk and subject to their own terms and privacy policies.

9. Availability and changes to the Service

DeltaTrace is provided on an "as available" basis. We do not guarantee that the Service will be available at all times, free from errors, or compatible with every device or browser.

We may modify, suspend or discontinue any part of the Service at any time, for example to:

• Add, remove or change features.
• Perform maintenance or updates.
• Address security or performance issues.

Where reasonably possible, we will try to avoid making changes that materially degrade the Service, but we reserve the right to make changes at our discretion.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.

In particular, we do not warrant that:

• The Service will be uninterrupted, secure or error-free.
• The data, graphs or analysis provided by DeltaTrace will be accurate, complete or suitable for any particular purpose.
• Defects will be corrected.

You use DeltaTrace at your own risk. Any reliance you place on data or outputs from the Service is strictly at your own discretion.

11. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for:

• Any indirect, incidental, special, consequential or punitive damages.
• Any loss of profits, revenue, data, or business opportunities.
• Any loss or damage arising from your use of or inability to use the Service, or from any reliance on data or outputs from DeltaTrace.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

Please read the Privacy Policy carefully to understand how your information is collected and used, including how we use third-party analytics tools such as Google Analytics 4.

By using DeltaTrace, you acknowledge that your personal data will be processed in accordance with the Privacy Policy.

13. Governing law

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of Hungary, without regard to conflict of law principles.

If you are a consumer and mandatory consumer protection rules in your country provide you with additional rights, those rights remain unaffected.

14. Changes to these Terms

We may update these Terms from time to time, for example when we add new features or change how the Service operates.

The "Effective date" at the top of the page shows when these Terms were last updated. If changes are significant, we may provide additional notice (for example, via a banner on the site).

By continuing to use DeltaTrace after changes take effect, you agree to the updated Terms.
